These general contracting conditions, as well as any specific conditions that may be established, regulate the use of the website www.cristalrecord.com (hereinafter "CristalRecord"), which is owned and managed by CristalRecord, S.L.U ( VAT: B-50631175).The navigation through the website, the use and/or purchase of any of the products available at CristalRecord, implies the total acceptance by the user/client of each and every one of the present general contracting conditions, of the general conditions of use of the website, as well as, if applicable, of the particular conditions that may be established. These general contracting conditions are protected by the provisions of Law 34/2002, on Information Society Services and Electronic Commerce; Law 7/1998, on General Contracting Conditions; Royal Decree 1906/1999, which regulates Telephone or Electronic Contracting with General Conditions in development of Article 5.3 of Law 7/1998 and any other regulations that may be legally applicable

1.- THE OBJECT

By accepting these general conditions of sale, the user/client consents to and accepts joining the portal www.cristalrecord.com, after registering as authorised by CristalRecord, and will have his/her personal data included in CristalRecord's files and databases, which will be processed by CristalRecord in accordance with the relevant legislation and the Privacy Policy of this website. CristalRecord may allow users to access information from third parties or, through links, to other websites managed by third parties, for whose content, information, errors, or omissions CristalRecord has no responsibility whatsoever. Therefore, the user's browsing through mentioned websites not belonging to CristalRecord will be under his/her sole and exclusive responsibility, with total liability for CristalRecord.

The pictures, files, graphic or iconographic representations related to the products offered, including commercial names, brands, distinctive signs of any kind or denominations contained on the website, are only for informative purposes or guidance, in order to offer as much information as possible to the customer, but without having a contractual character with CristalRecord.

2.- CRISTALRECORD.COM

The users agree and accept to use the CristalRecord website and its contents correctly, lawfully and diligently, and especially not to make any use of it that might be contrary to it' s own purposes or to the law. Registered users or buyers are responsible for ensuring that the information they provide for registration is complete, true and correct. Users may access their completed and/or recently shipped orders in the password-protected private professional area. This private area for professional users also allows you to change, manage and save your personal customer information. In case users violate or breach any of these general conditions as well as the online sales conditions agreed upon particularly with customers and registered users, CristalRecord reserves the right to warn the user, modify or delete content published by the user on the website, or if necessary, delete the account for access to the private area of the website. The users will be responsible for any damages, of any nature, that may be caused because of the failure to comply with any of the rules of use of the website, its general conditions, and conditions of sale online as well as any obligation that is required by law. CristalRecord is not responsible for the errors or omissions that this website may contain, nor for any damage, direct or indirect, that may arise from its use.

3.- THE PRODUCTS

All product descriptions and information, as well as product availability posted on our website is for information purposes only, which does not lead to any commitment on the part of CristalRecord. The pictures, technical data sheets, plans or videos related to the products offered, including brands, commercial names or denominations contained in CristalRecord, are only for guidance purposes, to provide the buyer and client with as much information as possible about all the products, but they are not guaranteed by CristalRecord. In addition, if, due to circumstances beyond CristalRecord's control or due to force majeure, the product is available within the indicated period and under the agreed conditions once the purchase has been made, CristalRecord will inform the buyer by e-mail of the total or, if applicable, partial cancellation of the order, reimbursing the amount once the return has been confirmed and accepted by the buyer.

CristalRecord reserves the right to make any changes to improve the product.

4.- ONLINE ORDERS – TO BUY IN CRISTALRECORD

All orders that users have placed through the CristalRecord website may only be submitted through the private professional area of the website with prior authorization from CristalRecord. Once the creation of a customer account has been requested, CristalRecord will send confirmation of registration along with the access codes to the private area, which will allow the customer to manage online orders directly from our website, check the availability of stock of our products, as well as access to promotions and exclusive content, available only on our website. All shopping processes remain the responsibility of the purchaser. Once the order has been placed, the customer will receive an email with the validation and confirmation of the order. Within 24/48 hours from the notification/confirmation of the order, the order will be delivered (Peninsula and Portugal shipments, excluding holidays). Other destinations such as the Balearic Islands, the Canary Islands, Ceuta, Melilla. The international destinations do not include Delivery Service. Upon a special agreement with the commercial department, the international the orders will be delivered within 7-10 days from the date of order confirmation.

All the information that any registered user or customer provides to CristalRecord will be treated in accordance with the current legislation and in accordance with its Privacy Policy. Likewise, in the case of direct shipments to end customers (Dropship service), all personal data received by CristalRecord regarding those customers will be used only for the management and shipment of the order, never for subsequent commercial purposes or for commercial dissemination or communication. CristalRecord is not responsible for the subsequent management of the data by third parties, who are the only ones responsible for the non-compliance with the data protection policy of the CristalRecord portal.

The formal written or verbal offers made by CristalRecord, S.L.U. or its commercial network are for information purposes only, and in no way signify a commitment to accept orders.

5.- LOGISTICS. PRICING POLICIES AND SHIPPING COSTS

Orders placed by any registered user through the CristalRecord website will be subject to the prices offered and listed on the product's website at the time of placing the corresponding order unless there is an error in the order. In any case, CristalRecord reserves the right to modify the prices of the products offered at any time, without prejudice to the fact that these will be invoiced at the price in force at the time of registration of the order. All information relating to price comparisons, discounts applied to products and/or savings obtained by users are calculated based on CristalRecord's current price list.

The prices of the products that appear on the website do not include Value Added Tax (VAT), which will be calculated at the time of the order. However, this amount does not in any case include the shipping costs of the products, which are shown in the user's shopping cart at the time a product is added to the shopping cart. The total amount of the order costs, including the costs generated by transport, as well as the VAT will be displayed completely at the time before confirming the order. CristalRecord is not responsible for any errors or omissions that may be contained on the website regarding prices.

CristalRecord sends its products to the entire Iberian Peninsula and Portugal within 24/48 hours (excluding holidays). Freight paid deliveries correspond to orders over 360 EUR for deliveries in the Iberian Peninsula and Portugal. For orders under 360 EUR, a charge of 9 EUR will be made on the invoice for the order delivered.

Shipments to the Spanish Islands (both Canary and Balearic Islands) will be made within 5/7 days of order validation/confirmation. Carriage paid deliveries correspond to orders over 500 EUR for deliveries to the Spanish Islands. For orders under 500 EUR, an invoice of 25 EUR will be issued for this purpose for the delivered order.

For shipments to Ceuta or Melilla consult price to CristalRecord (CristalRecord website does not allow online sales to these destinations).

CristalRecord also sends its products to international destinations: Germany, Austria, Belgium, France, Italy, Luxembourg, Netherlands, and United Kingdom. Carriage paid deliveries correspond to orders over 400 EUR for international shipments. For orders under 400 EUR, a charge of 30 EUR will be made for this concept in the invoice for the delivered order.

For other international destinations, please contact CristalRecord. We can also offer EXWORKS conditions (Incoterm 2020) upon request.

6. -PAYMENT METHODS

CristalRecord offers the following online payment methods:

Bank card: Caixa's secure payment gateway to pay by credit or debit card. (Recommended).

Bank transfer: The order will not be considered confirmed until the transfer for the requested amount has been made to the bank account specified when the order was placed. If you want to anticipate the preparation time of the order, it will be necessary to send the proof of payment by email to orders@cristalrecord.com.

Other conditions: To maintain the conditions of purchase that have been assigned as a customer CristalRecord, you must mark Keep My Own Conditions as a Customer.

7.- DELIVERY OF THE PRODUCT

CristalRecord is committed to manage the shipment of the product properly and efficiently to the buyer, at the address indicated by the user in the purchase process or prepare the relevant order for the customer for the collection of the order. It is the client's responsibility to ensure that the delivery can be made to the address provided during the working hours in which the courier companies make their deliveries. In that sense, CristalRecord reserves the right to cancel the order in case it is not possible to carry out the delivery due to the client's responsibility, as the client is not at the address indicated in the schedule. In this case CristalRecord will have to refund the amounts paid by the customer, except for the shipping costs, which will not be refunded and will be paid by the buyer/client.

Once the purchase process has been completed and the payment of the total amount of the order has been received, CristalRecord will proceed with the preparation and shipment of the order in the indicated time frame. The delivery will be considered effectively made from the moment the product has been made available to the customer at the indicated place of delivery.

In case the product or products sent have any damage (inside or outside) when they are delivered or it is detected that the product arrives in bad condition or with damage - for reasons beyond CristalRecord- the customer must notify immediately and in writing to orders@cristalrecord.com within 24 hours after receiving it, attaching the maximum information about the damage and photographs of the product's breakage to process the claim correctly. After this period of 24 hours, CristalRecord will not be responsible for any claim for these reasons.

CristalRecord will not accept claims related to errors in quantities, types or prices received by the customer if they are not made within 15 days from the date the order was received. For any difference that could arise in the interpretation or fulfilment of the operations by CristalRecord, S.L.U and the client, this one resigns of his own jurisdiction or legislation, he submits expressly to the jurisdiction of the Tribunals and Courts of Zaragoza, Spain.

8.- RETURNS - ORDER CANCELLATION

If, once the order has been placed and paid, you wish to modify or cancel it, you must contact CristalRecord as soon as possible on +34 976 459 277 or send an email to orders@cristalrecord.com indicating in detail the reason for changing the order.

The client has 24 hours from confirmation of the order to modify it free of charge. If the request for order change is received after 24 hours from the date of placing the order and receipt of the order confirmation by email, the cancellation or change of the order will not be able to be attended to (since the order will already be in the preparation phase or will even have been sent). Therefore, there will be no problem in returning the order* but the shipping costs generated by the return and shipment of the order will be assumed by the customer/buyer, and therefore will not be reimbursed, being deducted from the total amount of the order at the time of payment. The return shipping costs will also be paid by the customer/buyer.

The customer/buyer will have to return the order and all the products (with all their accessories) in their original packaging in perfect condition and protected so that the refund can be made. If these conditions are not met, CristalRecord reserves the right to refuse the return. If the items are not returned in the original packaging, these will suffer a price devaluation of 35% for review, verification and change of packaging. In case the product or products sent have any damage when delivered, the client must notify it immediately, in writing sending an email to orders@cristalrecord.com, attaching the maximum information about the damage with pictures of the product damage.

It is very important that you provide us with as much detail as possible about the cause of the return of the order so that our sales and after-sales team can find the best solution and resolution of the incident in the shortest time and in the fastest way possible.

When the return has been checked, verified and confirmed by CristalRecord, the amount will be refunded.

The damages produced to the goods because of the transport will be subsisted if the claim is communicated to CristalRecord within 24 hours from the reception of the order. After this period of 24 hours, CristalRecord reserves the right not to replace the damaged material. No returns of material will be accepted without prior notice from the customer. This notice must be made in written form through the web form or by sending an email to orders@cristalrecord.com, for the written approval of CristalRecord.

Any return over 15 days from the reception of the order will suffer a price devaluation of 25%. If the items are not returned in the original packaging, these will suffer a price devaluation of 35% for review, verification and change of packaging. No returns will be accepted in the following cases:

- Items that have been used or handled before the return.

- Returns of articles in bad conditions, goods or packaging that have not been reflected in the transport document.

- Items supplied more than one month before the date of the return request.

- Excess stock by the buyer.

L.U. with the purpose of providing the requested service, that is, its treatment is legitimized in the execution of a commercial contract in which you are a party.

These data may be communicated to banks for the payment of invoices, to the AEAT and to the Public Registries for the fulfilment of the corresponding obligations. However, no international transfer of data is foreseen. 11.- LEGAL WARRANTY

All the articles and products commercialized by CristalRecord have a 2 years guarantee from the date of purchase of the product. It is important to keep the purchase invoice (its presentation is necessary to make any check, change or return). You can find your invoice in your customer account in our online store.

According to the Royal Legislative Decree 1/2007, of November 16, 2007, on the improvement of consumer and user protection, a legal guarantee of 2 years from the date of delivery of the product is granted for goods of a durable nature. The customer and consumer must inform CristalRecord.com of the lack of conformity within 2 months from the date of knowledge of it. It is important to emphasize that it does not include the deficiencies caused in the product by negligence, hits, use or undue manipulations, not suitable tension, incorrect installation of the product as well as products submitted to wear and tear by its normal use.

In those incidents that justify the use of the legal warranty, CristalRecord will opt for the repair, replacement of the article, discount, or return, in the terms established by law.
